01 Agreement
These terms govern your use of impaccenergy.com and its tools, including the system designer at /build, and your requests for quotes, prequalification and appointments. By using the site you accept them. If you do not accept them, do not use the site.
“IMPACC”, “we” and “us” mean IMPACC Developments Corporation, a Texas corporation at 5955 Alpha Rd, Dallas, TX 75240. “You” means the person using the site.
02 Who may use it
You must be at least 18 and legally able to enter contracts. To proceed to a survey you must own the property, or have written authority from the owner. We currently install in Texas, Illinois, Missouri, Kansas, Arkansas and Louisiana; addresses elsewhere cannot be quoted. Online pricing is available in some of those states and not yet in others — where it is not, the tool says so and puts you with a consultant.
03 Estimates are not contracts
Nothing produced by the design tool is an offer, a contract, or a guaranteed price. It is an estimate generated from the information you enter and from aerial survey data, and it is expressly subject to a physical site survey.
Panel counts, production figures, system size, pricing and monthly payments shown on the site may change once a technician has inspected the roof, the electrical panel and the site. Roof condition, structural capacity, shading, obstructions, equipment availability, permitting, homeowners-association rules and utility interconnection requirements can all change the design or make a project unworkable. If that happens we will tell you before anything is signed.
A binding agreement arises only when you and IMPACC sign a written installation or power purchase agreement. Those documents, not this site, govern the work.
04 Production and savings figures
Production estimates are modelled from Google aerial survey data, the usage you enter, and standard industry assumptions about equipment losses. Savings comparisons use the electricity rate implied by the bill and usage you give us, and assume utility rates rise over time. That assumption is an assumption, not a promise.
Actual production and actual savings depend on weather, shading, roof condition, equipment performance, your consumption habits, and future utility rates and rate structures — including changes to net metering and to fixed charges, which continue to apply whichever option you choose. We do not guarantee any level of production, savings, or bill reduction except where a signed agreement expressly says so.
05 Financing
IMPACC is not a bank, a lender, a broker or a credit repair organisation. Financing is offered by independent third parties under their own terms, rates and approval criteria.
- A prequalification is a soft credit inquiry. It does not affect your credit score, is not an application for credit, and does not guarantee approval or any particular rate or term.
- Rates, terms, promotional periods and fees shown on this site are supplied by the lender and can change without notice. The lender’s documents control.
- Final terms come from the lender in writing after a full application and underwriting.
- Lenders may require specific equipment brands, documentation or property conditions.
By requesting a prequalification you authorise IMPACC to transmit the information you provide to the financing partner you select, and you authorise that partner to obtain a soft credit report.
06 Incentives, credits and tax
Incentive amounts shown on this site are estimates based on published programme figures current at the time of display. Programmes change, funding blocks fill, prices step down, and eligibility is decided by the programme administrator and the utility — not by us.
For Illinois systems, Illinois Shines renewable energy credit payments are made on the programme’s own schedule across a 15-year delivery contract, with a portion at energization and the remainder over subsequent years. They are not a discount off the purchase price and are not paid as a lump sum at installation.
We do not provide tax advice. Whether any credit, deduction or incentive is available to you depends on your circumstances. Consult a qualified tax adviser before relying on any figure shown here.
07 Appointments and site surveys
Requesting an appointment is a request, not a confirmed booking, until we confirm it. Someone 18 or over who is authorised to make decisions about the property should be present. A survey typically takes about 45 minutes and requires access to the roof exterior, the electrical panel and the meter. We may need photographs, utility bills and documents for permitting, interconnection and incentive applications.
Please give us reasonable notice if you need to cancel or reschedule.
08 Text messages and calls
By providing a telephone number and consenting on a form, you agree that IMPACC and those acting for it may call and send text messages to that number about your project, including appointment confirmations, reminders and follow-up, using automated technology where applicable.
- Consent is not a condition of purchase.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to end messages; reply HELP or call 214-500-8878 for help.
- Carriers are not liable for delayed or undelivered messages.
- We do not share mobile numbers or SMS consent with third parties for their marketing.
See the Privacy Policy for how this information is handled.
09 Your responsibilities
You agree to give accurate information, including usage, bill amounts and property details, and to tell us if it changes. Estimates built on inaccurate information will be inaccurate. You agree not to misuse the site: no scraping, no interference with its operation, no attempt to gain unauthorised access, no use of it to submit another person’s information without their permission.
10 Intellectual property
The site, its design, text, tools and the IMPACC name and marks belong to IMPACC or its licensors. You may use the site for your own evaluation of a solar system for your property. You may not copy, republish or exploit it commercially without written permission. Map and aerial imagery belongs to Google and is subject to Google’s terms.
11 Third-party links
We link to lenders and other third parties. We do not control those sites and are not responsible for their content, terms or privacy practices.
12 Disclaimer
The site and its tools are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that any estimate it produces will prove accurate.
This section does not affect any express warranty given in a signed installation agreement, or any right you have that cannot be waived under law.
13 Limitation of liability
To the fullest extent permitted by law, IMPACC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost savings or loss of data, arising from your use of the site — including reliance on any estimate — even if we were advised such damages were possible.
To the fullest extent permitted by law, our total liability arising from your use of this site is limited to one hundred dollars ($100). This limit does not apply to liability under a signed installation agreement, which is governed by that agreement, and does not apply to liability that cannot be limited by law.
14 Indemnity
You agree to indemnify IMPACC against claims arising from your misuse of the site, your breach of these terms, or your submission of another person’s information without authority.
15 Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute arising from the site or these terms will be brought exclusively in the state or federal courts sitting in Dallas County, Texas, and you consent to their jurisdiction.
Before filing anything, please contact us at privacy@impaccenergy.com or 214-500-8878 so we can try to resolve it directly. Nothing here limits any right you have to contact a state regulator or attorney general.
16 General
If a provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy and any signed agreement between us, are the entire agreement about the site. We may update these terms; the effective date above will change and continued use means acceptance.
